These Terms of Service ("Terms") govern your access to and use of Privanode ("Privanode," "we," "us," or "our"), operated by privanode.app. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Privanode.
1. Eligibility
You must be at least 18 years old to use Privanode. By using the service, you represent that you meet this requirement and that you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive sanctions by Canada, the United States, or the European Union, and that you do not appear on any restricted or denied-party list maintained by such authorities. We reserve the right to suspend or terminate any account found to violate this section without refund.
2. The Service
Privanode provides access to third-party large language models and related AI tools through a unified chat interface, on a pay-as-you-go credit basis. We do not develop or train the underlying AI models ourselves; we route your requests to third-party model providers and return their output to you.
No warranty on AI output
AI-generated content may be inaccurate, incomplete, or inappropriate for your purposes. You are solely responsible for evaluating and verifying any output before relying on it. Do not use Privanode for medical, legal, financial, or safety-critical decisions without independent professional verification.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.
4. Credits and Payment
- Access to AI models is granted through a credit balance. Credits are purchased in advance and consumed based on actual usage (approximately proportional to the computational cost of each request).
- Credits do not expire.
- Credits have no cash value, are non-transferable between accounts, and are not redeemable for cash except as required by law or as described in our Refund Policy.
- We accept payment via credit/debit card (processed by Stripe) and select cryptocurrencies (processed by Plisio). We do not store your full card number or crypto wallet private keys; these are handled directly by our payment processors under their own terms and privacy practices.
- Prices and credit-package sizes may change at any time. Changes do not affect credits you have already purchased.
5. Acceptable Use
Use of Privanode is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation may result in suspension or termination of your account without refund of unused credits.
6. Intellectual Property
You retain any rights you may have in the prompts you submit. Subject to the terms of the underlying model providers, you may use AI-generated output for your own purposes, at your own risk regarding accuracy and any third-party rights that may be implicated by the output. Privanode's branding, website, and software are our property or that of our licensors and may not be copied or reused without permission.
7. Service Availability
Privanode is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue any part of the service at any time.
8. Limitation of Liability
To the maximum extent permitted by law, Privanode and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service, including reliance on AI-generated output. Our total liability for any claim arising from these Terms or the service is limited to the amount you paid us in the three (3) months preceding the claim.
9. Indemnification
You agree to indemnify and hold Privanode harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any law or third-party right.
10. Termination
We may suspend or terminate your access at any time for violation of these Terms, the Acceptable Use Policy, suspected fraud, or legal/regulatory reasons. You may stop using the service at any time; unused credits are handled per our Refund Policy.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms. Material changes will be noted with an updated "Last updated" date.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or the service will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
